Hello! I’m a patient that has some extra connoisseur grade MMJ for sale. The strain is Blubonic and features a tropical fruit punch type of smell, with hints of pine and Banana Laffy Taffy. It also has a distinct purple tinge to many of the nugs. At lower doses it will deliver a clear, euphoric, happy daytime high, with no burned out or slowed down feeling. Attorney Leonard Frieling discusses everything you need to know about marijuana and DUI (Driving Under the Influence) laws. If you get pulled over and an officer suspects you of DUI for being “impaired” on cannabis, what should you do? Should you show the officer your medical marijuana card? Should you consent to a search? Should you perform the voluntary roadside sobriety tests? Should you consent to a blood or breathalyzer test? You need to know the answers to these questions *before* you get pulled over so you can save yourself from a felony conviction or loss of your drivers license.

The number of THC/DUI cases in Colorado has increased dramatically. According to the Denver Post, in 2009, there were about 800 THC blood tests requested. In 2010, there were 1600 tests requested, and in March 2011, there were already another 1100 blood samples submitted for testing in only the first three months of the year.

Yet CDOT statistics show no increase in traffic fatalities or accidents, so the increased number of tests does not correlated with any decrease in safety on the road. Perhaps the increase in tests is due to overzealous law enforcement officers who might see a medical marijuana patient as an easy target. The THC/DUI bill was, afterall, promoted strongly by law enforcement and the drug treatment industry, who saw a THC/DUI per se law as job security.

About the Leonard Frieling
Lenny Frieling is an experienced Colorado criminal defense and DUI attorney with a long and distinguished career of service to the cannabis community. As an expert on cannabis law and DUI law, he lectures frequently to many groups including the NORML Legal Committee and the Colorado Bar Association. He is a former Lafayette Municipal Court Judge and served a term on the Colorado Municipal Judges Association Board of Directors.

He was instrumental in educating Colorado legislators this year about the dangers of HB 11-1261, a bill that attempted to create a DUI per se limit of 5 ng/mL of THC in the whole blood. Lenny criticized the bill for being poorly-written and not based on science. The bill was eventually killed, but it will likely be introduced by another legislator next year.
